The option just doesn't appear on the dip menu. I haven't confederated with anyone in double the length of the cooldown. Did so with Red Fangs and Bloody Spearz. Wurrzag isn't a savage git so I don't understand the problem.

Jon had taken Donal and Benjen’s advice to heart: Sam may be fat and pathetic, but he is still a member of the watch, and one of the few black brothers who isn't a rapist or thief. (out of context, this sounds ridiculously racist)

We had a NAP and I upgraded it to DA cause I needed money. The option still wasn't there when we had a NAP.

Do you have the FLC installed? Strange and very unlikely question, but I once tried it by uninstalling (unchecked the box in Steam Library window) and tried confederating and the option disappears. Maybe you have the same issue.
Use of mods also might be a factor. Rome2 wouldn't load into main menu until I uninstalled some (which I swear I already tried doing in the past).
